KAGOZ TERMS OF SERVICE

Introduction

Welcome to Kagoz. These Terms of Service ("Terms") govern your use of kagoz.com and all related services (collectively, the "Service"). By accessing or using Kagoz, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree with these Terms, you must not use Kagoz.

Kagoz is operated by Kagoz Ltd., a company registered in Bangladesh with its office at 123, Road 7, Mohammadia Housing Ltd, Mohammadpur, Dhaka 1207, Bangladesh.

Accepting These Terms

By creating an account, listing a business, writing a review, or otherwise using Kagoz, you agree to these Terms. If you are using Kagoz on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

You must be at least 18 years old to use Kagoz. If you are under 18, you may not create an account or use our Service.

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of Kagoz after changes take effect means you accept the updated Terms.

Using Kagoz

What Kagoz Provides

Kagoz is a free business directory that helps people in Bangladesh find local businesses. We verify business information, publish listings, enable customer reviews, and provide search and discovery tools.

We provide the platform, but we do not own, operate, or control the businesses listed on Kagoz. Business listings are created by business owners or sourced from public information. Reviews are written by users, not by Kagoz.

User Accounts

You may browse Kagoz without creating an account. However, you need an account to write reviews, save favorite businesses, or list a business.

When you create an account, you must provide accurate and complete information. You are responsible for keeping your password secure and for all activity that occurs under your account.

You may not share your account with others, create multiple accounts, or create an account using false information. If we suspect fraudulent activity, we may suspend or terminate your account.

Acceptable Use

You agree to use Kagoz only for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent information about any business.
• Write fake reviews or pay others to write reviews for your business.
• Post reviews for businesses you own, operate, or have a financial interest in.
• Attempt to manipulate business ratings or search rankings.
• Harass, threaten, or impersonate other users or businesses.
• Use automated tools, bots, or scrapers to collect data from Kagoz.
• Attempt to gain unauthorized access to our systems or other user accounts.
• Upload viruses, malware, or other harmful code.
• Violate any applicable laws or regulations in Bangladesh.
• Infringe on intellectual property rights, privacy rights, or other rights of others.

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts of users who violate our rules.

Business Listings

Listing Your Business

Business owners can list their businesses on Kagoz for free. To create a listing, you must provide accurate information including business name, category, address, phone number, and business hours.

By listing your business, you represent that:

• You own the business or have authority to list it on Kagoz.
• All information you provide is accurate, current, and complete.
• You have the right to use any photos, logos, or content you upload.
• Your business operates legally in Bangladesh with required licenses and permits.
• You will update your listing promptly when information changes.

Business Listing Guidelines

Business listings must follow our guidelines available at kagoz.com/business-guidelines. We reserve the right to reject, remove, or modify any listing that does not meet our quality standards or violates our guidelines.

We verify business information before publishing listings. Verification typically takes 24 hours. We may contact you by phone or email to verify your business details.

Premium Listings

We offer premium listing options for businesses that want additional visibility and features. Premium listing terms, pricing, and features are described at kagoz.com/pricing.

Premium listings are paid subscriptions. By purchasing a premium listing, you agree to pay the fees and follow the additional terms that apply to premium services.

We may change premium listing prices or features with 30 days notice. Changes do not affect existing subscriptions until renewal.

Reviews and Ratings

Writing Reviews

Users can write reviews and rate businesses on Kagoz. Reviews must be based on your genuine experience with the business.

When you write a review, you agree that:

• Your review is based on your actual experience as a customer.
• You are not affiliated with the business or its competitors.
• You were not paid or compensated to write the review.
• Your review is honest, accurate, and does not contain false information.
• Your review does not include offensive language, personal attacks, or discriminatory content.

We verify reviewer identity using phone verification. Only verified users can write reviews. We use fraud detection technology to identify and remove fake reviews.

Review Guidelines

Reviews must follow our review policy available at kagoz.com/review-policy. We may remove reviews that violate our guidelines or these Terms.

You retain ownership of your review content, but you grant Kagoz a worldwide, royalty free license to use, display, and distribute your reviews on our platform.

Business Owner Response to Reviews

Business owners can respond to reviews about their business. Responses must be professional and factual. Business owners may not threaten reviewers or offer compensation to change reviews.

Businesses cannot pay to remove negative reviews. We remove reviews only if they violate our guidelines or contain false, defamatory, or illegal content.

Intellectual Property

Kagoz Content

Kagoz and all content, features, and functionality on our website are owned by Kagoz Ltd. This includes our logo, design, text, graphics, software, and compilation of business listings.

Our content is protected by copyright, trademark, and other intellectual property laws in Bangladesh and internationally. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

User Content

You retain ownership of content you submit to Kagoz, including reviews, photos, and business information. By submitting content, you grant Kagoz a worldwide, non exclusive, royalty free, perpetual license to use, display, modify, and distribute your content on our platform.

You represent that you own or have permission to use any content you submit and that your content does not violate any third party rights.

Trademarks

Kagoz, the Kagoz logo, and other marks used on our website are trademarks of Kagoz Ltd. You may not use our trademarks without our written permission.

Business names, logos, and trademarks displayed in listings belong to their respective owners. Listing a business on Kagoz does not grant us ownership of business trademarks.

Limitation of Liability

To the maximum extent permitted by Bangladesh law, Kagoz and its owners, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Service.

Our total liability to you for any claims arising from these Terms or your use of Kagoz shall not exceed 10,000 Bangladeshi Taka.

Some jurisdictions do not allow limitations on certain warranties or damages, so some limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Kagoz, its owners, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of Kagoz in violation of these Terms.
• Content you submit to Kagoz.
• Your violation of any rights of another person or business.
• Your business activities if you list a business on Kagoz.

Third Party Services

Kagoz may contain links to third party websites, services, or businesses. We do not control, endorse, or assume responsibility for third party content or services.

When you click on external links or interact with businesses listed on Kagoz, you leave our platform and are subject to the terms and policies of those third parties.

We integrate with third party services like Google Maps for directions and social media platforms for sharing. Your use of these services is subject to their terms and privacy policies.

Termination

You may stop using Kagoz at any time. You may delete your account by contacting us at support@kagoz.com.

We may suspend or terminate your access to Kagoz at any time, with or without notice, for any reason including:

• Violation of these Terms or our policies.
• Fraudulent or illegal activity.
• Multiple complaints about your conduct.
• Technical or security reasons.
• Legal requirements or court orders.

Upon termination, your right to use Kagoz immediately ends. We may delete your account and content, though some information may remain in backups for a limited time.

Provisions of these Terms that by their nature should survive termination will remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.

Dispute Resolution

These Terms are governed by the laws of Bangladesh. Any disputes arising from these Terms or your use of Kagoz will be resolved in the courts of Dhaka, Bangladesh.

Before filing any legal claim, you agree to first contact us at support@kagoz.com to try to resolve the dispute informally. We will work in good faith to resolve disputes quickly and fairly.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy at kagoz.com/privacy-policy and any other policies referenced herein, constitute the entire agreement between you and Kagoz regarding use of our Service.

Waiver and Severability

Our failure to enforce any provision of these Terms does not waive our right to enforce it later. If any provision is found unenforceable, the remaining provisions will remain in effect.

Assignment

You may not assign or transfer these Terms or your account to anyone else. We may assign these Terms to another company if Kagoz is sold or merged.

Notice

We may provide notices to you by email, posting on our website, or other reasonable means. You agree that electronic communications satisfy any legal requirements for written notice.

Language

These Terms are written in English. If we provide a translation in Bengali or another language, the English version controls in case of any conflicts.
